It is further agreed that the ORGANIZATION will: permit upon request by the INSTITUTION, inspection of the premises in which any student is working under this Agreement, and will review with the INSTITUTION the working conditions and job requirements of all such students. be responsible for the supervision of work performed by students' participation in any project under this Agreement. be responsible for advising students on procedures to follow for reporting of emergencies, accidents, problems, or potential hazards in the work environment. provide professional direction and staff to assure that the work to be performed is responsibly supervised and is consistent with the purposes of the Act, and is in compliance with local, state, and federal labor laws and regulations. have at least one permanent employee at each designated work site to supervise FWSP student employees at that site at all times. Such supervisors shall be listed on the Work Site Contact/Supervisor Information form, attached hereto and incorporated herein as Exhibit A. abide by the information provided in each student's authorization and employment contract (and any subsequent written notification), with respect to the amount of the award, hours permitted to work and dates of employment. Maintain a complete and accurate written job description for all students employed through the FWSP Community Scholars Program, as provided by 91Ƶר College. Evaluate FWSP student employees in accordance with FWS program policies and procedures. This evaluation shall include, but is not limited to, the completion of a Student Employee Performance Appraisal for each FWSP student employed. This evaluation must be completed for each semester/term of employment. Abide by the INSTITUTION'S termination of a student's employment and agree that under no circumstance will the INSTITUTION be responsible for employment or compensation of hours worked beyond a student's termination in the FWS program. Further, the ORGANIZATION agrees to assume full responsibility for employment and 100 percent compensation of the hourly wage rate for all students who work beyond termination. Abide by the Fair Labor Standards Act of 1938, as amended, which, among other things, prohibits employers from accepting voluntary services from any paid employee. -2- Reimburse the INSTITUTION for any costs or expenses incurred by the INSTITUTION resulting from the ORGANIZATION'S failure to fulfill its obligations under this Agreement and/or failure to comply with any applicable federal or state law with respect to students employed under this Agreement. Submit all required correspondence and documentation to: 91Ƶר College Center for Career Development and Experiential Education 401 Rosemont Avenue Frederick, MD 21701-8575 INSTITUTION RESPONSIBILITIES The INSTITUTION shall: advise and assist the ORGANIZATION with regard to the aspects and regulations of 91Ƶר College Federal Work Study Community Scholars Program. maintain a complete and accurate written job description for all students employed through the 91Ƶר College FWS Community Scholar Program. be responsible for the identification, recruitment, selection, and placement of all 91Ƶר College Community Scholars participants. In addition, the INSTITUTION shall: determine that the students meet the eligibility requirements for employment under the program and authorize the students to work for the ORGANIZATION. be responsible for collecting, processing, and maintaining all payroll documents as required by the 91Ƶר College payroll system to include, but not limited to, Student Employment Authorization forms, I-9 Employment Eligibility Forms, and W-4 Tax Withholding Certificates. be responsible for the proper withholding of FICA, Workers Compensation, Federal, State, and Local taxes as required by federal, state, and local laws. be responsible for 100% of the total gross compensation paid to students for all hours appropriately worked and authorized under this Agreement, and the disbursement thereof. notify the ORGANIZATION of the total FWS award amount, hourly pay rate, total hours available to work, and beginning and end dates of employment for each student employed. have the right and power to require the student to terminate employment when he/she ceases to be eligible for participation in the program. have no obligation to provide any given number of FWSP student employees to any given work site. -3- ORGANIZATION/INSTITUTION RESPONSIBILITIES It is agreed by both parties that: Neither INSTITUTION nor ORGANIZATION shall discriminate on the grounds of sex, race, age, color, national origin, or disability in accordance with Title IV of the Civil Rights Act of 1964, Title IX of the Educational Amendments of 1972, the Americans with Disabilities Act, and Section 504 of the Rehabilitation Act of 1983. FWS students may not work more than 15 hours per week while 91Ƶר College classes are in session. A FWS student may not work in excess of his/her total FWS award amount or in excess of his/her employment contract. Any hours worked in excess of the foregoing weekly limits or a student's authorization and employment contract or total FWS award shall be compensated by the ORGANIZATION. The ORGANIZATION will adhere to all policies and procedures of 91Ƶר College and the Federal Work-Study Program as provided by the 91Ƶר College. The ORGANIZATION understands and acknowledges that failure to follow these guidelines may result, among other things, in a loss of FWS employee assistance.
